# Peru Apparel Labelling and Resolución 2109 Requirements

# Peru Apparel Labelling: The Andean Rule, RUC and Legal Domicile

Apparel sold in Peru is governed by Resolución N° 2109/2019, as modified by Resolución N° 2173/2020, in force in Peru since 14 February 2021. This is Peru's own applicable garment-labelling rule, covering material composition, care instructions and country of origin as the permanent-label content, and it is treated as a sworn declaration: the resolution expressly states that no conformity-assessment procedure applies to the garment label itself. Peru layers its own general manufactured-product labelling law on top of that garment rule. Decreto Legislativo N° 1304/2016 requires the responsible Peruvian manufacturer, importer, packer or distributor to be locally identifiable, including a legal domicile and a Peruvian tax identification number, the RUC. A Peru-bound label is therefore two fields sets combined into one artwork: the garment-specific permanent content, and the general Peruvian responsible-operator identity. ## What must appear on an apparel label sold in Peru?

The permanent label must contain material composition, care and conservation instructions, and country of origin or manufacture. Manufacturer or importer identification and size may be presented on either a permanent or a removable label, giving some flexibility on where those two fields sit, unlike the three permanent-label fields. ## What does the RUC and legal-domicile requirement mean for a Peru-bound shipment?

Decreto Legislativo N° 1304 requires the responsible Peruvian manufacturer, importer, packer or distributor to state its legal domicile and RUC, Peru's tax identification number, in addition to the name and applicable tax identification named in the garment-specific resolution. This is the field that most clearly distinguishes a Peru-bound label from a generic Andean-region label: the responsible operator has to be identifiable inside Peru's own tax system, not only named as a company. INDECOPI's own guidance on Decreto Legislativo 1304 confirms the RUC and local responsible-party fields as the clearest national additions on top of the garment-specific rule, which is the reason a Peru order needs its responsible Peruvian entity, and that entity's current RUC, confirmed before label artwork is finalised rather than assumed from a general company registration. ## How does Peru's fibre-composition and tolerance rule work?

Materials at 5% or more of the garment must be declared individually and in descending order. Materials below 5%, or collectively below 15%, may be grouped as "otros." Functional fibres are named even below the 5% threshold, reflecting their role instead of their share of the total mass. A "100%," "puro" or "todo" claim tolerates unavoidable foreign fibres up to 2%, or 5% for carded products, and a tolerance of plus or minus 3% applies to each fibre in a mixture. Coating and lining are addressed under the resolution's own Article 7, and origin must be expressed as "Hecho en," "Fabricado en," "Elaborado en" or an equivalent phrase. ## Is there a mandatory care-symbol standard in Peru?

Yes. Resolución 2109, Article 8, requires care information in legends, standardised symbols, or both, and states that where symbols are used they must conform to ISO 3758:2012. This gives a Peru-bound programme a clear, confirmed symbol standard to build to. ## Does Peru require a pre-market certificate for apparel?

No. Resolución 2109 expressly states that no conformity-assessment procedure applies to the garment label, and label information is treated as a sworn declaration by the responsible party, not something certified by a third party before the goods reach the market. Enforcement, correspondingly, is conducted in the market by INDECOPI instead of through pre-import certification, which places the compliance emphasis on the accuracy of what is declared rather than on clearing a pre-shipment approval step. ## What happens if a Peru-bound label is inaccurate or incomplete?

INDECOPI supervises and sanctions both the general Decreto Legislativo 1304 labelling obligations and the garment-specific Andean rule. Under Ley N° 29571, the Consumer Protection Code, administrative consequences can include warnings, corrective measures and fines classified by severity, reaching up to 450 UIT for very serious consumer-law infringements. Since the label is a sworn declaration and not a certified document, the accuracy of what is stated carries the compliance weight, and a mismatch between the label and the finished garment is treated as a labelling infringement in its own right. A separate Peruvian standard, NTP 231.400:2015, addresses apparel and household-textile labelling and is marked "Obligatoria" in INACAL's own catalogue. Its interaction with the later supranational Resolución 2109 is not clearly explained in the accessible primary material, so a Peru-bound programme should treat Resolución 2109 as the directly applicable mandatory garment rule and confirm any additional NTP 231.400 requirement separately rather than layering it in without checking current legal incorporation. ## How should a Peru-bound label be approved before bulk?

Confirm the responsible Peruvian operator's role, manufacturer, importer, packer or distributor, along with its legal domicile and current RUC, before development samples are finalised, since a change to how the shipment is commercially structured changes which entity's tax identity belongs on the label. Confirm fibre composition against the 5% and 15% grouping thresholds, and care symbols against ISO 3758:2012, at the same stage.
